En dépit de témoignages explicites d'auteurs anciens, auxquels des historiens modernes ont fait confiance, la date tardive du Phèdre ne fait plus de doute. Ce résultat est dû aux études stylistiques bien plus qu'aux travaux d'exégèse. Quand il s'agit de définir le sens et le but du dialogue ou de démêler les liens qui le rattachent aux autres dialogues ou à des écrits contemporains, on est loin d'aboutir à un accord. Platon veut-il simplement établir le programme d'une rhétorique philosophique pour (...) faire pièce à l'action envahissante des écoles de rhétorique ? Vise-t-il plus spécialement telle ou telle doctrine rhétorique ? Vu les points de contact avec des écrits d'Isocrate, d'Alcidamas et d'autres, a-t-il peut-être voulu trancher certaines questions brûlantes, intervenir en conciliateur ou en arbitre ? Le fait est que l'examen dialectique se termine à la p. 272b par la récapitulation et la réponse définitive à la question posée p. 258d et reprise p. 259e. Alors que le débat portait sur le logos en tant que discours écrit ou prononcé, Socrate introduit dans la finale la notion du logos de l'âme pour répondre aux objections de Phèdre. Alors qu'il a prouvé (261e-262b) la nécessité de la connaissance de la vérité, peu importe de quel genre de discours il s'agit, il revient en arrière pour discuter à nouveau la théorie de la vraisemblance de Tisias appliquée au seul genre judiciaire. Pourquoi, après chacune des objections (273d-274a, 278bc) répéter la conclusion finale et reprendre coup sur coup le problème de l'œuvre écrite, qu'il avait expédié en passant, p. 257d-258d ? Au terme de cette dernière diversion, Socrate oppose à la philosophie les techniques spéciales qui lui sont subordonnées : législation, poésie, éloquence. Est-ce peut-être dans ce message destiné à Lysias et doublé d'un message analogue à Isocrate que Platon a voulu nous donner la clef de l'œuvre ? Le Phèdre été conçu comme un drame parfait axé sur la mission et la condamnation de Socrate et cette structure lui donne son sens et son unité. Le cœur, c'est la péripétie et cette „reconnaissance” dans laquelle le daimonion ouvre les yeux de Socrate. Ecoutant son daimonion, il embrasse ses dieux à lui, son Eros, et dès lors sera traité d'impie par le jury. Les politiques, les poètes et les orateurs impuissants à appuyer leurs paroles (par la philosophie) (273c) deviendront ses accusateurs, et c'est Socrate qui, ignorant leur éloquence, sera impuissant à se défendre. On lui reprochera de corrompre la jeunesse. C'est que son discours ici se termine par cette prière significative : „Accorde-moi... d'être, plus encore qu'à présent, en crédit auprès des beaux garçons” (257a trad. Robin). Bref, la scène du Phèdre est le prélude, ou, si l'on veut, la contre-partie du drame de 399. Quel est le rôle de Lysias ? Exactement le même que dans la République et le Clitophon. Contrairement à son frère Polémarque (257b) il ne pense que politique et barreau, une politique qui en définitive adopte les principes de violence de Thrasymaque (Rép. I et Phèdre 266c). Dans une soi-disant Défense de Socrate, il a répondu à Polycrate en ramenant toute l'affaire sur le plan purement politique et en reniant le verdict de 399, imputable à l'absence d'une défense efficace. Soucieux du relèvement de la démocratie, il désire reléguer à l'arrière-plan l'affaire de 399, faire oublier les griefs religieux et peut-être tendre la main aux Socratiques, pour, ainsi, passer à l'ordre du jour. Or, se prêter à cette manoeuvre, pour Platon, c'est renier son maître. Que reproche-t-il à Lysias ? De tourner le dos à la Philosophie en médisant d'Eros. Et nous apprenons en finale, pour mettre fin à toute équivoque, qu'Isocrate n'échappe pas à ce même reproche. Mais tout cela se situe à l'arrière-plan. Dans la trame du Phèdre, celui qui est directement accusé d'impiété, celui qui s'accuse lui-même, c'est Socrate. S'il n'y avait vu clair, s'il avait quitté ce lieu sacré après un succès oratoire sur un thème imposé par Lysias, il aurait renié ses daimonia ; il aurait trouvé grâce auprès des hommes, mais serait justiciable des dieux (242d). Dans ce cas le drame, le vrai drame du Phèdre, n'aurait pas eu lieu et Socrate aurait échappé à son arrêt de mort. (shrink)

Deux ques t ions impor tantes sont rarement posées à propos de l’introduction possible de Quotas Individuels Transférables dans les pêcheries : Pourquoi n’y a-t-il que deux pays dans le monde, l’Islande et la Nouvelle Zélande, qui ont introduit un système compréhensible de QIT dans leurs pêcheries? et : qui s’occupe de la privatisation des biens d’accès libre? L’expérience de l’Islande peut donner quelques réponses. Dans une première partie, l’évolution du système de QIT en Islande entre 1975 et 2000 (...) est décrite comme un processus difficile de marchandage. D’une part les coûts de marchandage furent abaissés par la crainte répandue de la disparition des stocks de poisson, et par la relative homogénéité dans les pêcheries pélagiques. D’autre part ces coûts furent augmentés, par l’hétérogénéité dans les pêcheries démersales, avec des différences immenses entre les propriétaires de petits bateaux et ceux de grands chalutiers, ainsi que des différences entre les régions. Dans la seconde partie, est décrite la nature du système de QIT: alors que ceux qui détiennent des QIT jouissent de droits d’extraction plutôt que de la propriété, l’introduction du système de QIT équivaut à clôturer partiellement les stocks de poisson dans les eaux d’Islande, résolvant ainsi la plupart des problèmes associés à la “tragédie des communs”. Le système a plutôt bien opéré mis à part quelques problèmes subsistants, en particulier le statut légal incertain des QIT et les prises de premier choix. La troisième partie décrit les controverses actuelles au sujet du système des QIT. Nous démontrons que le seul moyen de rendre l’introduction de ce système acceptable pour les propriétaires d’un capital de pêche était d’allouer des quotas sur la base de l’histoire des prises, et qu’une taxe spéciale sur la location des ressources serait injuste car elle frapperait ceux qui ont choisi de rester dans les pêcheries et non ceux qui ont été mis à l’écart.Two important questions are rarely asked about the possible introduction of ITQs in fisheries: Why are there only two countries in the world, Iceland and New Zealand, which have introduced a comprehensive ITQ system into their fisheries? and: Who cares whether the commons is privatized? The experience in Iceland may provide some answers. In Part 1, the evolution of the ITQ system in Iceland in 1975-2000 is described as a difficult process of bargaining. Costs of bargaining were lowered by the widespread fear of the collapse of the fish stocks, and by the relative homogeneity in the pelagic fisheries. Those costs were increased, on the other hand, by the heterogeneity in the demersal fisheries, with vast differences between owners of small boats and large trawlers, and also between regions. In Part II, the nature of the ITQ system is described: while those who hold ITQs enjoy rights of extraction rather than property, the introduction of the ITQ system amounts to the partial enclosure of the fish stocks in Icelandic waters, solving most of the problems associated with the “tragedy of the commons”. The system has performed quite well although some problems remain, in particular the uncertain legal status of the ITQs and high-grading. In Part III, current controversies about the ITQ system are described. It is argued that the only way to make the introduction of the system acceptable to owners of fishing capital was to allocate quotas on the basis of catch history, and that a special resource rent tax would be unjust, since it would hit those who chose to remain in the fisheries, not those who were bought out. Students of the history of ethics sometimes find themselves tempted by moderate or extreme versions of an approach that might roughly be called ‘historicist’. This temptation may result from the difficulties of approaching historical texts from a ‘narrowly philosophical’ point of view. We may begin, for instance, by wanting to know what Aristotle has to say about ‘the problems of ethics’, so that we can compare his views with those of Aquinas, Hume, Kant, Sidgwick, and Rawls, and then decide what (...) is true or false in each theorist's position. But this narrowly philosophical attitude soon runs into difficulties, and writers on the history of ethics often warn us against it. (shrink)

This study takes up a portion of the early hagiography of a Japanese prince who was reputedly a reincarnated Chinese monk, and uses a peculiarity in a colophon dated 718 to argue that though the text may have been composed in China, it must in that case derive from the writing of a Japanese visitor. A possible identification of the visitor is made, and some attention is given to the likely sources he used.

To compare a novel to a work of philosophy is, admittedly, a risky exercise in analogy. When the novelist is Lawrence and the philosophical text is the ponderous and dialectical Being and Nothingness, such a comparison may seem willfully perverse and peculiarly open, insofar as it deals with Lawrence's great theme of sexuality, to his anathema of "sex in the head." Furthermore, modern criticism, especially in the Anglo-Saxon world, has tended to be wary of critical approaches that lean on notions (...) that are not derived from literature itself - a tendency that is being reinforced these days by the structuralist insistence on the "literariness" of the Text. Now, despite its metaphorical statement as a form of dramatic "gesture," Sartre's book is very definitely not a work of literature. T.H. Adamowski, associate professor of English at Erindale College, the University of Toronto, has written articles on English, American, and French literature. Objectives: To quantify the use of do-not-resuscitate orders in a tertiary-care children’s hospital and to characterise the circumstances in which such orders are written.Design: Retrospective study conducted in a 500-bed children’s hospital in Taiwan.Patients: The course of 101 patients who died between January 2002 and December 2005 was reviewed. The following data were collected: age at death, gender, disease and its status, place of death and survival. There were 59 males and 42 females with a median age of 103 months (...) . 50 children had leukaemias, and 51 had malignancies other than leukaemia. The t test and the χ2 test were applied as appropriate.Results: The study found that 44% of patient deaths occurred in the paediatric oncology ward; 29% of patient deaths occurred in the intensive care unit; and 28% of patients died in their home or at another hospital. Other findings included the following: 46 of 101 patients died after attempted cardiopulmonary resuscitation and 55 died with a DNR order in effect. The mean age at death was 9.8 years in both groups with or without DNR orders.Conclusions: From the study of patient deaths in this tertiary-care children’s hospital, it was concluded that an explicit DNR order is now the rule rather than the exception, with more DNR orders being written for patients who have been ill longer, who have solid tumours, who are not in remission and who are in the ward. Ancient critics often argue that the Stoic moralists really have no substantive disagreement with Aristotle, but simply say the same things in more violently paradoxical terms. One of the Stoics’ most acute critics, the sceptic Carneades, claims that on the whole question about goods and evils, the Stoics and Peripatetics differ about terms, not about the facts. On this view, the apparently extravagant Stoic claims about virtue, happiness, good, and evil, really agree with Aristotle. As Cicero says, when we take (...) a closer look at the Stoic position, it seems much less amazing than it initially seemed. (shrink)

Etymology might encourage us to begin a discussion of Aristotle on philanthropy with a discussion of philanthropia ; and it is instructive to see why this is not quite the right place to look. The Greek term initially refers to a generalized attitude of kindness and consideration for a human being. The gods accuse Prometheus of being a ‘human-lover’, intending the term in an unfavorable sense, when he confers on human beings the benefits that should have been confined to the (...) gods. Aristotle uses the abstract noun only once, to refer to sympathetic fellow-feeling ; and he mentions our feeling of kinship with other human beings to explain our approval of the philanthropos person. Philanthropia is the attitude of a kind and considerate person, even if she lacks material resources, and it can be displayed without the transfer of material resources. (shrink)
